Terms of Service

Last updated October 16, 2026

These terms are the agreement between you and BlackMarkit (“BlackMarkit,” “we”) when you use the BlackMarkit website and apps. By creating an account or using BlackMarkit, you agree to them.

The short version
  • BlackMarkit is a marketplace. Sellers sell their own items; we run the platform, payments and protection.
  • Sellers keep 100% of their price and shipping. Buyers pay a Buyer Protection fee (5% of the item price + $0.70 per order).
  • Money is held until delivery so buyers are protected, then released to the seller on a published schedule.
  • No fakes, no scams, no harassment. Our seller rules use a transparent 3 Strikes system.
  • We give at least 14 days’ notice before changing fees or these terms.

1. Who can use BlackMarkit

You must be at least 18 years old and able to form a binding contract. You need an account to buy, sell, bid, make offers or message. Keep your sign-in email secure; you're responsible for activity on your account. One person may not run accounts to get around a suspension.

2. What BlackMarkit is

BlackMarkit connects people who want to buy and sell clothing, shoes, accessories and related items. Unless we say otherwise, BlackMarkit is not the seller of items listed by users and does not own or inspect them. Sellers are responsible for their listings and items. We provide the marketplace, process payments through our payment partner Stripe, hold funds until delivery, and run Buyer Protection.

3. Listings and content

  • Listings must describe the item honestly, including its condition, size, flaws and whether it's authentic. Photos and videos must be of the actual item and taken or owned by you.
  • You keep ownership of what you post. You give BlackMarkit a non-exclusive, worldwide, royalty-free license to host, display, resize and promote your listings, posts and profile on BlackMarkit and in our marketing, for as long as they're on the platform (and a reasonable time after for marketing already published).
  • Don't post anything illegal, hateful, sexually explicit, misleading, or that infringes someone else's rights. See the prohibited items list in Selling on BlackMarkit.

4. Buying

  • When you pay, you agree to buy the item at the price and shipping shown, plus the Buyer Protection fee (5% of the item price + $0.70 per order). Accepted offers set your price. The full total is shown before you pay.
  • The Buyer Protection fee pays for payment processing, holding your money until delivery, and reviewing problems. It's refunded along with your purchase whenever an order is refunded in full.
  • A bid in an auction is a commitment to buy if you win. A bid in the last 2 minutes extends the auction by 2 minutes.
  • Payment is taken when you check out and held by BlackMarkit until the order is delivered and the protection window passes.
  • Check your item when it arrives. Tapping “I got it, all good” confirms the order and releases payment to the seller right away.

5. Selling, fees and payouts

  • To sell, you must set up payouts with Stripe and agree to Stripe's terms. Stripe verifies your identity and holds your bank details; BlackMarkit doesn't see them.
  • There's no selling fee: you keep 100% of the item price. When you use a BlackMarkit prepaid label, the shipping the buyer pays covers the label (or, with free shipping, the label price comes out of your payout); when you ship on your own, the shipping the buyer pays goes to you. BlackMarkit earns from the Buyer Protection fee buyers pay and from optional boosts. BlackMarkit pays the card processing.
  • Boosts are free to turn on. If a boosted item sells within 14 days of being boosted, a boost fee of 10% of the item price (8% for Founding Sellers) applies, even if you turned the boost off.
  • Fees are taken from the sale before your payout. Your payout breakdown is shown on every order.
  • Payouts are released after delivery on the schedule in Selling on BlackMarkit. We may hold a payout while a buyer's problem report or card dispute is open.
  • If an order is refunded after you were paid (for example, after a chargeback the seller is responsible for), we may recover the amount from your future payouts.

6. Shipping

Sellers must ship within 3 business days of a sale and use a BlackMarkit prepaid label or add a valid tracking number. See the buyer and seller shipping policies.

7. Problems, refunds and disputes between users

A $1.49 refund fee is charged to whoever was at fault when a dispute is decided: the seller when it's decided for the buyer (taken from their next payout), or the buyer when it's decided for the seller (added to their next checkout). Sellers who cancel an order after it sells pay a $2.99 cancellation fee. There's no fee for packages lost or damaged in transit.

If an item doesn't arrive, arrives damaged, isn't as described or isn't authentic, report it from your order before the payout is released. We'll review the order, may ask both sides for photos or information, and decide whether to refund the buyer, return the item or release payment. Our decision on Buyer Protection claims is final on the platform, but it doesn't limit any rights you have under law or with your card issuer.

8. Rules and enforcement

We enforce our rules with the transparent 3 Strikes system. Every warning, strike, listing removal or suspension comes with the reason and a way to appeal. Some conduct (counterfeits, scams, fake tracking, threats or harassment) can lead to immediate suspension. You can close your account at any time; open orders must still be completed.

9. Verified badges

A verified badge means BlackMarkit reviewed a seller's application and confirmed they're the brand or shop they say they are. It is not a guarantee of any specific item. We can remove a badge if a seller no longer meets the requirements or breaks the rules.

10. Our responsibilities and limits

We work to keep BlackMarkit running, safe and accurate, but the service is provided “as is.” To the extent the law allows, BlackMarkit isn't liable for indirect or consequential losses, or for the acts of other users, and our total liability to you for any claim is limited to the greater of the fees you paid us in the 12 months before the claim or $100. Nothing in these terms limits liability that can't be limited by law.

11. Changes to these terms

We'll post any change on our News page and notify you at least 14 days before changes to fees or these terms take effect, unless a change is required sooner by law or to prevent fraud. Continuing to use BlackMarkit after a change takes effect means you accept it.

12. Governing law

These terms are governed by the laws of the State of New Jersey, USA, without regard to conflict-of-law rules. Before filing any claim, please support@blackmarkit.us.com so we can try to resolve it informally.
